Additional Tariffs on Products from Canada, Mexico, and China
On February 1, 2025, President Trump signed executive orders that assess additional duties on goods with country of origin Canada, Mexico, and China. This includes goods originating in those countries but exported from other countries.
Presidential Actions – The White House
Expected to be released on Monday:
- Advance version of Federal Register notice of the Presidential Actions for all three countries
- Notice of HTSUS Chapter 99 numbers and list HTSUS numbers that are defined as energy and energy products for Canada
- CBP CSMS messaging regarding implementation, including instructions for how importers will certify their claim of exemption based on timing of vessel loading or in transit status
Effective:
- The orders implemented the additional duties on goods entered for consumption, or withdrawn from consumption, on or after 12:01 a.m. Eastern time on February 4, 2025. Exception for goods that were loaded onto a vessel at the port of loading or in transit on the final mode of transport prior to entry into the U.S. before 12:01 a.m. eastern time on February 1, 2025 only if the importer certifies this fact to CBP.
- On February 3, 2025, President Trump advised there is a one-month delay for goods from Mexico.
- We are on stand-by for updates regarding a potential delay for goods from Canada and China.
Rates – applied in addition to any other duties:
- Canada:
- 10% for energy and energy products
- 25% for all other merchandise
- Mexico:
- 25% for all merchandise
- China:
- 10% for all merchandise
Exclusions:
- No language to authorize exclusions.
FTZ Admissions:
- Must be entered in privileged foreign status, unless eligible for domestic status.
Drawback:
- No drawback may be claimed on these duties.
De minimis:
- Section 321 / de minimis treatment is not allowed. Duty and fees are applicable to low value
shipments.
Retaliatory Actions:
- States if retaliatory duties or actions are taken, the President may increase or expand in scope
the duties imported under these orders.
Duration:
- Applicable until the President determines sufficient action is taken to alleviate the crisis.
