    Data protection principles for DB Schenker in the Americas

    The protection of your personal data is important to you - and to us as well.

    Because of that, we will inform you on this page about which data we collect, why we need this data and how you can contradict the data collection.

    1)  Who is the party responsible for data collection and processing?

    2) When and why does DB Schenker collect and process personal data?

    We are aware how important it is to you that your personal data is handled carefully when you make use of our services. We are happy that you have chosen to use our website, and wish to provide you with transparent information as to whether and when your personal data are collected and processed.

    All data collection and processing is performed for specific purposes. These may result from technical necessities, contractual requirements, or explicit customer requests.  We use the data or information to provide the services’ functionality, fulfill your requests, improve the services’ quality, engage in research and analysis relating to the services, personalize your experience, track usage of the services, market the services, provide customer support, message you, back up our systems, allow for disaster recovery, enhance the security of the services, and comply with legal obligations. Even when we do not retain such information, it still must be transmitted to our servers initially and stored long enough to process.

    For technical reasons, certain data might be collected and stored during a visit to any dbschenker website.  As for example, the date and duration of the visit, the web pages used, the identification data of the browser and operating system type used, and the website from which you visit us.

    Digital email and customer E-newsletter

    If you register to receive communications for general advisories, service alerts, promotional materials direct or by email, or one of our newsletters, the following required information is collected: Salutation, first name, last name, E-Mail address, Company name, address, city, state, zip, country, industry you are working in, and preferences for publications to receive.  We may share this information with our vendor, Oracle Eloqua, whose use of the information is limited strictly to the following purposes:  (1) sending emails to you; (2) tracking links for engagement in those emails; (3) using a landing page feature to promote sales; (4) scoring visitors to our website based on sites visited to drive sales emails; (5) tracking visitors that have provided consent to see what content they are viewing on our site; and (6) sending automated emails based on results.

    In this case, we may use your e-mail address for promotional purposes.

    If you sign up for to receive any or all digital communications from DB Schenker, we save the IP address of the computer system assigned to you by your Internet service provider (ISP) and the date and time of registration. We save this data to track (potential) abuse of the email address of a data subject, for our own legal protection. You can unsubscribe at any time under website section “About Us, Connect with Us, Customer e-News“ or by clicking the unsubscribe link on the bottom of any email you receive from DB Schenker.

    If you object to the promotional use of your data, your data will only be used anonymized, for statistical analysis purposes.

    If you register for a user profile at eSchenker

    When you set up a user profile, you may give us the following personal data:

    First name or forename, last name or surname, age, gender, company, company address, country, email address, telephone number, facsimile or fax number, preferred language, contact person at DB Schenker, IP address, device(s) used, pages visited, time spent on our websites, category for consultation, selection of publications to receive, consents to receive, subscribe, unsubscribe, date last updated preferences, date unsubscribed, and comments.

    We use these data without your individual consent for the handling of your registration with eSchenker, and for the associated IT services. You can have your user profile deleted at any time by contacting support.eschenker@dbschenker.com. Access to the individual IT services may no longer be available as a result. If you request that your user profile be deleted, your data will only be used in anonymized form and for statistical analysis purposes. On the one hand, we wish to make general use of the information thus collected to continuously improve our services. On the other hand, we wish to continuously adapt our services to your demand and requirements. You can object to the use of your data for analysis purposes by emailing support.eschenker@dbschenker.com.

    To the extent that you register and utilize the forms loaded onto our site at ts.dbschenker.com or otherwise initiate a transactions with us, further data we may collect includes whether you previously registered, whether you are an employee, whether you are applying for company or clients, type of business, whether you previously used carnets, when you plan to apply, website, title, business cell phone, password, bond type, requested amount, other bond amount (if desired), principal goods to be insured, estimated total annual shipments and values, estimated maximum individual shipment value, % breakdown as between ocean import/export, air import/export, principal areas shipped to/from (checklist), cargo information (list), survey type, shipper/consignee, date survey required, special instructions, taxpayer identification number, type of credit card, credit card number/expiration date/security code/card holder name, purchase plan options, and interests.  We use this data with your express consent to provide you the requested services.

    We may also store information that you provide through communications to us, including from phone calls, letters, emails and other electronic messages, or in person.

    To continuously improve our offerings, we save and analyze usage data from the online area on a pseudonymized basis. The legal basis for this is Article 6(1)(f) GDPR.

    To the extent that we request consent to process your personal data, it serves as the legal basis according to Article 6(1)(a) GDPR.

    For processing of personal data required to fulfill a contract with you, the contract is the legal basis according to Article 6(1)(b) GDPR. Article 6(1)(b) GDPR also apples to processing operations that are required to execute preliminary measures, for example, if you ask about our products or services.

    If our company is subject to legal demands that require us to process personal data, for example, to fulfill tax responsibilities, then processing is based on Article 6(1)(c) GDPR.

    If you click on a link to an external page, you will move outside the pages of dbschenker.com/usa. Schenker Inc. is therefore not responsible for the content, services or products offered on the linked website and also for the privacy and technical safety on the linked website.

    3) When will your data be deleted?

    Your data will be deleted as soon as they are no longer required for the purpose for which they were collected (e.g. within the framework of a contractual relationship) and further for any period of time for which we must retain this data to meet legal requirements. Your data must also be deleted if it is not permissible to store them (particularly if the data are inaccurate and correction is not possible). Where legal or practical obstacles prevent deletion, the data are blocked (e.g. special archiving obligations).

    4) Are data encrypted?

    The transmission of data and emails via the internet is generally unencrypted, and is therefore unprotected against third-party access.  In order to protect the data in your eSchenker user profile, the connection to the user profile is always encrypted using SSL. When you contact us by email, the confidentiality of the information provided cannot be guaranteed during the transmission; we therefore recommend that confidential information should be sent exclusively by letter or other more secure means.

    5) What rights do users of eschenker.dbschenker.com have?

    You can request information about what data is stored about you.

    You may request rectification, deletion and limitation of the processing (blocking) of your personal data as long as this is legally permissible and possible within the framework of an existing contractual relationship.

    If you have set up a user profile, you can have it deleted.

    You have the right to transfer the data that you have provided us on the basis of a consent or a contract (data portability).

    If you have given us consent for data processing, you can revoke it at any time in the same way that you have granted it. The revocation of the consent does not affect the legality of the processing due to the consent until the revocation.

    6) Are data disclosed to third parties?

    For the execution of the contract, the activation of instructions-dependent processors is usually a must, such as data center operators, printing or shipping service providers or other parties involved in the performance of the contract.

    External service providers, who process data for us, are carefully selected by us and are strictly contractually obligated. The service providers work according to our instructions, which is ensured by strict contractual regulations, by technical and organizational measures and by supplementary controls.

    Furthermore, your data will only be transmitted if you have given us your express consent or because of a legal regulation.

    Transmission of data from the EU/EEA to third countries outside the EU/EEA or to an international organization shall not take place unless there are adequate guarantees. These include the EU standard contractual clauses and an adequacy decision of the European Commission.

    7) When are cookies used?

    We want to give you the opportunity to make an informed decision for or against the use of cookies, unless these are not strictly necessary for the technical functioning of the website.

    8)  Do third parties receive information about me?

    e.    Third Party Accounts: If you sign up for, or log into, our websites using a third party service like Facebook or Google, or link your Schenker account to your account with a third party service like Facebook or Twitter, we may receive information about you from such third party service. If you post content to a third party service through our websites, that third party service will also receive that content, which will be visible to anyone that has access to it through that third party service.

    9) Web analysis service - Matomo

    We use the Matomo analysis service on our website. Small text files (cookies) store data about how you use our website, including your IP address. These data are anonymized and stored by us. If you do not wish to agree to the analysis of your use of our website, you can change your browser settings at any time to prevent cookies from being used. In this case, however, it may be the case that not all functions can be used.

    10) Feedback service

    We use the Usabilla feedback service on our website. The opportunity to leave feedback to Schenker is voluntarily and you are not forced to do so. If you deny to give feedback once, we will not ask you again. The feedback process is completely anonymous, no personal data such as IP address, login name, user name etc. is captured and stored, neither in Schenker nor in Usabilla. Small text files (cookies) store data about how you use our website. This data is anonymized and stored by us. If you do not wish to agree to the analysis of your use of our website, you can change your browser settings at any time to prevent cookies from being used. In this case, however, it may be the case that not all functions can be used.

    11)  Use of Adobe Analytics

    This website uses Adobe Analytics, a web analysis service from Adobe Systems Software Ireland Limited (Adobe Systems Software Ireland Limited, 4-6 Riverwalk, Citywest Business Campus, Dublin 24, Republic of Ireland). By using this analysis service, we aim to ensure that our website is designed to meet the requirements and is continually being optimized. We also use the analysis service to statistically record the use of our website which we evaluate in order to optimize our content.

    Adobe Analytics uses cookies with a lifetime of 24 months which are stored on your end-user device and enable your use of the website to be analyzed.

    The information generated by the cookie is transferred to and stored on an Adobe server in the European Union. Prior to this, since a procedure for anonymizing your IP address is activated on this website, your IP address will be shortened. Adobe will use this information in order to evaluate for us your use of the website, to compile reports on website activities and to carry out additional services, on our behalf, relating to use of the website and the internet. This enables us to assess how often different sections and texts on our web pages are read, and whether or not our website design influences the extent of website usage. The statistics obtained enable us to improve our content and make it more interesting for you as a user.

    Adobe shares this information with us exclusively as aggregate data showing general site usage. This data has no personal content and cannot be traced back to an individual.
